Spendcast — Terms of Use

Effective Date: March 1, 2026

These Terms of Use ("Terms") govern your use of the Spendcast application ("App"), developed and published by PerfectAim ("we," "us," or "our"). By downloading, installing, or using Spendcast, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, in accordance with Apple's Usage Rules set forth in the App Store Terms of Service.

You may not:

Copy, modify, distribute, sell, or lease any part of the App
Reverse-engineer, decompile, or disassemble the App
Remove, alter, or obscure any proprietary notices in the App
Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to the App's underlying code or systems

2. Subscriptions and In-App Purchases

Spendcast may offer premium features through subscriptions or one-time in-app purchases, processed entirely through Apple's App Store.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually, depending on the plan you select) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may manage and cancel your subscription at any time through your Apple ID Account Settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes

Subscription prices may change from time to time. If a price increase takes effect, you will be notified in advance and given the opportunity to confirm or cancel before being charged the new rate, in accordance with Apple's policies.

Payment

All payment processing is handled by Apple. We do not receive, store, or have access to your payment information. For questions about billing, refunds, or payment issues, please contact Apple Support or visit reportaproblem.apple.com.

3. User Responsibilities

You are responsible for:

Data Accuracy — Ensuring the accuracy of all financial data you enter into the App. Spendcast processes what you provide and cannot verify the correctness of your entries.
Device Security — Maintaining the security of your device, including passcode, Face ID, or Touch ID settings. Since all data is stored on your device, your device security is your data security.
Backups — Backing up your device if you wish to preserve your Spendcast data. Deleting the App will permanently remove all associated data from your device.
Lawful Use — Using the App only for personal, lawful purposes and in compliance with all applicable laws and regulations.

4. Financial Disclaimer

Spendcast does not provide financial advice. The App is a personal finance tracking and organization tool. Any insights, summaries, projections, or suggestions generated by the App — including those from AI features — are for informational and organizational purposes only and should not be construed as financial, investment, tax, or legal advice. Always consult a qualified financial professional before making financial decisions.

We make no representations or warranties regarding the accuracy, completeness, or reliability of any financial calculations, forecasts, or AI-generated insights provided by the App.

5. Intellectual Property

The App and all of its content, features, and functionality (including but not limited to design, text, graphics, icons, and software) are owned by PerfectAim and are protected by international copyright, trademark, and other intellectual property laws.

"Spendcast" and the Spendcast logo are trademarks of PerfectAim. You may not use these marks without our prior written consent.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected. You use the App at your own risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PERFECTAIM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or financial opportunity
Errors or inaccuracies in financial tracking or calculations
Decisions made based on information provided by the App or its AI features
Loss of data due to device failure, app deletion, or any other cause
Unauthorized access to your device or data

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App or its subscriptions in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless PerfectAim and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your use at any time by deleting the App from your device.

Upon termination, all provisions of these Terms which by their nature should survive (including ownership, warranty disclaimers, indemnity, and limitations of liability) will continue to apply.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of the jurisdiction in which PerfectAim is established.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you through the App. Your continued use of the App after any modifications constitutes acceptance of the revised Terms.

12. Apple-Specific Terms

These Terms are between you and PerfectAim, not Apple. PerfectAim, not Apple, is solely responsible for the App and its content. Your use of the App must comply with the App Store Terms of Service.

Apple has no obligation to provide maintenance or support services for the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims. Apple is a third-party beneficiary of these Terms and may enforce them against you.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions will remain in full force and effect.
